CLIENT: the individual or organisation receiving services from Ever Prime Painters & Decorators
By choosing to engage Ever Prime Painting and Decorating for your project—whether through verbal agreement or by permitting work to begin—you automatically accept our Terms & Conditions. We encourage you to review these terms prior to the start of any work to ensure a clear understanding of our policies and procedures.
Deposit and Payment Terms
A deposit is required to secure your booking with us, and a detailed payment plan will be outlined in the contract for each client. Please note that failure to make payments on time may result in the suspension of services. Additionally, any late payments not adhering to the agreed-upon schedule will incur a penalty of 20% on the outstanding amount and escalated to debt agency at a further fee of 35%.
Payment for Completed Work
The Client agrees to pay the final invoice in full prior to the team leaving the property on the last day of work. Failure to make the payment as agreed will result in additional charges.
Quality Assurance
To ensure fair quality assurance, clients will be provided with a designated time window to inspect and assess the completed work before the project is finalised for payment. By making the final payment, the client confirms their satisfaction with the work. Ever Prime Painting and Decorating will not be held responsible for any issues that arise after this inspection period and once final payment has been received.
Completion Time
While the Contractor will strive to complete the work within the estimated timeframe, the completion date may change due to unforeseen circumstances. No additional charges will be incurred if the work is completed earlier or later than anticipated, unless unforeseen issues arise.
Cancellation and Rescheduling
Cancellation: The non-refundable deposit will not be returned if the Client cancels the project at any time prior to the start date.
Rescheduling: The Client may request to reschedule the start date only if notification is given 3 working days prior to starting work in writing. Rescheduling is permitted only within a 4-week window from the original start date. If no mutually agreeable date is found within this period, the cancellation policy will apply.
Changes to the Quote
If the Client makes any changes to the property or work required after receiving the quote, the Client must notify the Contractor immediately. Revisions to the quote will be made accordingly, and work may be delayed until a new price is agreed upon.
Client Responsibilities
Site Access and Charges
The Client agrees to provide access to the property for the duration of the project. If, for any reason, access is not granted on an agreed working day and the Contractor’s team arrives at the property, the Client will be charged for travel and lost time at the rate of £25 per man-hour for a standard working day of 7.5 hours.
Materials and Workmanship
Ever Prime Painting and Decorating will not be responsible for the suitability or performance of any materials supplied by the client. Should any discrepancies arise due to client error—such as the ordering of an incorrect colour/ or colour is not as expected, additional labour charges plus fuel cost will be incurred to rectify the mistake once work has commenced.
Damage and Liability
The Contractor will prepare and fill any small cracks or surface imperfections as part of the painting process. However, if significant cracks or structural issues are discovered during preparation, such as large, jagged cracks, misalignment of doors and windows, or substantial diagonal or vertical cracks the Contractor will notify the Client immediately.
These issues may indicate subsidence or other structural damage, and no further work will be carried out in the affected area until it has been assessed and repaired by a qualified professional.
If wallpaper is removed and the underlying wall is discovered to not be suitable for painting, the Contractor will not proceed with painting until the Client has confirmed they are happy to proceed or until necessary repairs, such as plastering or skimming, have been completed by a qualified professional.
The contractor shall not be liable for any indirect, incidental, or consequential damages arising from the discovery of such issues or any delays related to necessary repairs.
The Contractor shall not be liable for incidental damage to furniture, flooring, or fixtures unless caused by negligence. The Contractor is also not responsible for damages resulting from pre-existing conditions not disclosed by the Client, weather-related damage, or events beyond their control, such as theft or acts of God. The Client is responsible for ensuring that the work area is clear of personal items, all furniture must be either removed or adequately covered by the client. Ever Prime Painting and Decorating accepts no responsibility for any damage to furniture that is not removed or properly protected by the client.
Subcontractor Provision
The Contractor may, on rare occasions, engage subcontractors to complete specific aspects of the project, particularly when the Client has an exceptionally tight deadline. The Client acknowledges and agrees that direct engagement or negotiations with the Contractor's subcontractors regarding project scope or pricing are strictly prohibited. If a subcontractor fails to appear after a deposit has been made, the Contractor will seek a full refund from the subcontractor. A suitable replacement will then be arranged, and the Client will be informed of any delays this may cause . Should the Client choose to engage the subcontractor for the project after work has commenced, the Client shall be responsible for paying the Contractor the full contract amount for the entire project. This provision is intended to protect the integrity of the project and the Contractor’s business, ensuring that conflicts do not arise that could disrupt the progress of ongoing work.

We kindly ask clients to avoid commenting on or inspecting the work during the early stages of the project. Our team follows a detailed and structured process to ensure top-quality results. Feedback is welcome once significant progress has been made, as this allows us to deliver the best outcome.

To maintain a respectful and professional working environment, we discourage personal inquiries related to team members' backgrounds, religion, or beliefs. This policy helps keep the focus on the project while fostering collaboration and mutual respect. We appreciate your understanding and cooperation in creating a positive atmosphere for both our team and clients.
Right To Terminate
Ever Prime Painters reserves the right to terminate this contract in the event of aggressive behaviour, discriminatory language, or actions toward its staff. This includes racism, sexism, homophobia, and other forms of harassment. If the contract is terminated for these reasons, the Client will remain liable for all work completed to date.
The Client may not terminate this contract without reasonable cause. In the event of dissatisfaction or any issues arising, the Client must provide written notice to Ever Prime Painters, allowing a reasonable period for the Contractor to rectify the issue. If termination occurs after work has commenced the Client shall be responsible for payment for all work completed up to the date of termination, as well as any incurred costs related to materials and resources that cannot be recovered.
Reviews
We greatly appreciate client feedback and welcome constructive reviews to help us enhance our services. However, Ever Prime Painters reserves the right to take appropriate action, including legal measures, against false, misleading, or defamatory reviews. We are committed to maintaining the integrity of online feedback and will not tolerate malicious content. If a review violates the platform's guidelines or contains harmful misinformation, we may report it for removal. Our goal is to ensure that all reviews are fair, honest, and contribute to the improvement of our services.
Privacy Policy
Ever Prime Painters & Decorators will not share or sell the Client’s personal information to any third party unless required by law. The Client’s details may be retained for future correspondence, including marketing purposes, unless the Client opts out in writing.
By engaging the services of Ever Prime Painters, the Client confirms that they have read, understood, and agree to these Terms & Conditions in their entirety. It is the Client’s responsibility to review these terms prior to the commencement of any work.
